Terms of USe
Welcome to BNTO, a product of ViaVia Corporation ("we," "us," "our," "BNTO," or "VIAVIA"). These Terms and Conditions ("Terms") govern your use of BNTO's website at www.bnto.rent, BNTO’s website through any satellite website(s), and any BNTO iOS or Android mobile apps (collectively, the "Site"), including our product rental subscription and sale services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Services.
1. Account and Registration
To use our Services, you must create an account and provide accurate information. By creating an account, you confirm that you are at least 18 years old, reside in the United States, and will use the Services for personal, non-commercial purposes. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
2. Subscription Services
Subscribers can select six (6) items of merchandise (“Products” or “Product”) for a monthly fee of $98, excluding taxes. Some Products may be marked as premium and require an additional fee, and this additional fee may be a recurring monthly charge. Your subscription will automatically renew each month on your "Billing Anchor Date," which begins as the date you enrolled.
For example:
Subscriptions that begin on September 2 will have a Billing Anchor Date on the 2nd day of each month.
Subscriptions that begin on January 31 will have a Billing Anchor Date on the last day of each month (e.g., February 28, March 31, April 30, etc).
You may update your billing date by returning your current box and requesting a new billing date (including using our “Unlock Early” feature), which will then become your new Billing Anchor Date.
Your subscription will continue to incur one or more recurring subscription fees on your monthly Billing Anchor Date, even if you do not select and order Product(s) for rental or purchase, unless you pause or cancel your subscription.
3. Payment
BNTO accepts major credit cards as Payment Method, and we do not accept prepaid credit or gift cards (e.g., Visa gift cards), except for any gift cards provided by us. By providing a Payment Method, you authorize us to charge your monthly subscription fee to your Payment Method. BNTO may also update your Payment Method with information provided to us by our payment service providers; following any update, you authorize us to continue to charge the applicable Payment Method. You can update your Payment Method at any time through your account settings.
In the event of any payment failure, you are responsible for ensuring any unpaid, owed amount is promptly issued to BNTO. Even in the event of failed payment(s), every Billing Anchor Date that continues to occur will accrue additional recurring subscription fee(s) that is owed to BNTO.
Should your account have any failed payment(s) and your rented Product(s) have not been returned to us, those Products will be considered purchased, and you will be responsible to promptly pay the full purchase price for each unreturned Product.
Failed or unpaid payments, including for any subscription fees and/or for Product(s) purchase costs, may result in suspension or termination of your account, suspension or termination of your right(s) to use the Site or Services, legal action from BNTO, and/or reporting to credit or debt collection authorities.
4. Returns
You will receive return packaging, including a prepaid return shipping label, with each BNTO box. Use this packaging and shipping label to return all Products you do not wish to purchase. Please include all rented, non-purchased items in the same BNTO return. Using return materials or shipping labels not provided by BNTO may create processing delays, and please know BNTO is not responsible for any loss or damage of returned parcels that utilize shipping labels not provided by us.
Products not returned will be considered as intended for purchase, and we will charge your Payment Method accordingly. These charge amounts will be priced at the specific item’s current selling price in BNTO. Please contact Customer Support immediately if you have forgotten to return any item(s) from your BNTO, or you believe you were mistakenly charged for any item(s) you returned.
If you forget or neglect to include any non-purchased Product(s) in your BNTO return, please notify us immediately at support@bnto.rent. You will be responsible for any additional shipping costs to send any Product(s) to us that you did not include in the Product(s)'s accompanying BNTO return.
If you believe you returned a personal item in your BNTO return, please notify us immediately at support@bnto.rent. BNTO will not cover shipping costs for the return of personal items sent to us. Please know BNTO is not responsible for the care, safety, arrival or return of personal items that were sent to us.
5. Purchasing Products
You can purchase any Product in your BNTO box, provided you still possess the Product. The price of each Product is determined by its condition, the number of wears, and our AI-suggested dynamic pricing. All sales are final. Applicable state and local taxes will be added to your purchase.
6. Product Availability
While we strive to deliver the exact Products you select, availability is subject to change. If a selected Product is unavailable, we will choose a similar alternative, and we will provide you with bonus credits.
7. Pausing and Cancellation
You may pause your subscription for up to one (1) non-consecutive month at a time. Subscriptions will automatically resume after the pause period. You may cancel your subscription to end service immediately. To cancel or pause, log into your account and navigate to the “My Subscription” tab of your account settings. You cannot pause or cancel your subscription until you have returned your current BNTO box. If you do not return any Product(s), we will charge you for them at each item’s selling price. Kindly note your subscription will continue to incur one or more recurring subscription fees on your monthly Billing Anchor Date, even if you do not select and order Product(s) for rental or purchase, unless you pause or cancel your subscription.
8. Bonus Credits
Bonus credits are given by BNTO, and they may be used towards the purchase of any item you have rented that you would like to purchase as your own. For example, twenty (20) bonus credits equate to up to twenty U.S. dollars off the purchase of a rented Product. You can earn bonus credits through numerous methods, including subscribing, reviewing products, and successfully referring others. Paused accounts retain bonus credits, but canceled accounts forfeit them. Bonus credits have no value outside of providing a discount on the purchase of any Product(s) you currently have rented, and bonus credits may not be transferred. Unused bonus credits may not be cashed out or refunded.
9. Changes to Subscription Pricing
We may adjust pricing or Services at our discretion. If you do not agree with any changes, you may cancel your subscription. Continued use of the Services after changes take effect constitutes your acceptance of the new terms.
10. Refunds
Purchased Products are non-refundable. If you have not used any BNTO service in the current billing period and cancel the subscription, we will refund your current month's subscription fee.
11. Title and Risk of Loss
Title to Products remains with us until you purchase them. Risk of loss transfers to you upon delivery and returns to us when we receive the returned Products.
12. Communications
By enrolling in the Services, you consent to receive emails related to the Services, including marketing communications. You may opt-out of marketing emails at any time.
13. Colors and Styles
We strive to display colors and styles accurately but cannot guarantee that your screen will display them correctly.
14. Corrections
We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice.
15. Use of Site and Services
You may use the Site and Services for personal, non-commercial use only. Unauthorized use may result in suspension or termination of your account, suspension or termination of your right(s) to use the Site or Services, legal action from BNTO, and/or reporting to credit or debt collection authorities. Unauthorized use includes but is not limited to: harassment, impersonation, uploading illegal or abusive content, failure to pay subscription payments as part of our Services, and failure to return Product(s) after failed subscription payments.
16. DMCA Notice & Take-down Procedure
If you believe your work has been copied in a way that constitutes copyright infringement, please provide our Copyright Agent with the following information:
An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest;
A description of the copyrighted work that you claim has been infringed;
A description of where the material that you claim is infringing is located on the Site;
Your address, telephone number, and e-mail address;
A written statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law, including the law of fair use;
A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.

17. Feedback
By submitting feedback, including images or videos, you grant us a worldwide, perpetual, irrevocable, royalty-free license to use, copy, modify, and distribute your feedback for any purpose.
18. Disclaimer of Warranties; Limitation of Liability
The Site and Services are provided "as is" without warranties of any kind. We do not guarantee that the Site will be uninterrupted or error-free. Our liability is limited to the maximum extent permitted by law.
19. Indemnification
You agree to indemnify and hold BNTO and its affiliates harmless from any claims, damages, losses, or expenses arising from your use of the Services or violation of these Terms.
20. Arbitration Agreement
Any disputes arising from these Terms or your use of the Services will be resolved through binding arbitration on an individual basis. You waive the right to participate in class actions or class arbitration.
21. Governing Law
These Terms are governed by the laws of the State of California. Any disputes will be resolved in the state or federal courts located in San Francisco, California.
22. Entire Agreement
These Terms constitute the entire agreement between you and BNTO regarding the use of the Services. If any part of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
